Team Building with SIA Terms and Conditions

CLIENT OBLIGATIONS
1. The proposal made by the Company and the Price are dependent on the information provided by the Client. Costs incurred due to inaccurate information provided by the Client shall be merely the responsibility of the Client.
2. The Client is advised that Team building Activities, whilst generally very safe, carry some associated risk. Safety is the Company’s major concern at all times. The Client and all Delegates shall comply with all requests by representatives of the Company at all times during the Team building Event.

PAYMENTS
3. A deposit is required to secure booking for your event . The booking is not confirmed until the full payment funds are received in the Company’s bank account.
4. Other payments are due as advised by the Company. The balance payment is due 30 days before the event unless an alternative schedule is agreed in writing. The Event will not be delivered if all payments are not completed before the Event is planned to start.
5. The Client is responsible for all bank charges, exchange rate fluctuations and transfer costs and must ensure that the full amounts due are transferred to the Company’s account.
6. Payment Options
Telegraphic transfer of funds. Direct money transfer from the Client’s bank to our bank. The Client is responsible for all bank fees.

CANCELLATION POLICY
7. The Client may cancel at any time. Cancellation notification must be submitted to the Company contact noted in Schedule A and must be in writing Email is acceptable.
8. The Company shall confirm cancellations within 2 working days of receipt. Should the Client not receive a confirmation then the Client shall take diligent action to ensure that the Company is aware of the cancellation but the cancellation shall be considered as confirmed for the purposes of this Cancellation Policy.
9. In the event of Cancella-on by the Client:
a. The Client shall pay within 14 days of termination all Costs due at the time of termination as detailed in Schedule C;
b. The Company shall refund any amount due in line with this Agreement;
c. Any amount owed to the Company by the Client shall be offset against any refund due to the Client.
10. In the event of Cancella-on by the Company then the Client may reschedule the Event or seek a full refund of the Price plus reasonable costs incurred as a result of cancellation by the Company within 7 days of cancellation once from the Company.
11. In the event of Cancellation by the Client the following refund policy will apply in all situations with no exceptions with effect from the date that notification of your cancellation is received in writing to the Company contract listed in Schedule A.
a) The Company’s Team building Services charges:


b) Third Party Fees. Charges that have been paid to third party suppliers like hotels and catering companies are subject to the following policy:
i. The amount refundable will depend on the refund policy of the third- party supplier;
ii. If any refund is payable by the third party it will be claimed by the Company as the contracting party;
a) A non-refundable charge of 10% of the total refundable amount will be retained by the Company from any refund paid by the third- party supplier;
b) The balance will be refunded to the Client;
c) If this Agreement is cancelled due to Force Majeure, the Company is required to refund the Client 50% of Non-Dispersed Costs within 7 days of the Parties agreeing that the event was caused by Force Majeure.
d) To be clear, undesirable weather is not a Force Majeure event.

CHANGES
12. The Client may request changes to the Team-building Activities or to other aspects of the Event. Changes must be submitted to the Company in writing.
13. The price quoted is based on the number of attendees requested. A reduction in the numbers after contract signing will not automatically result in any reduction in charge. No refund will be paid or reduction agreed unless negotiated at the time of booking and documented as an annex to this Agreement. Additional attendees may result in additional charges being due.
14. The Company will assess what is required and advise the Client as soon as practical whether the change is feasible. If accepted by the Company the written change request and any response by the Company will be signed by the Company and Client representatives named in Schedule A and shall become part of this Agreement from the date that they are signed by both Parties.
15. The Company will do all it can to reduce any additional costs, but, in the event that additional costs are incurred, including work on the part of the Company, additional charges may be levied and must be paid by the Client before the Event.
16. The Company will only make changes when unavoidable. The company shall supply alternatives acceptable to the Client or refund the appropriate part of the Price.

INSURANCE
17. The Client is responsible for arranging their own travel, health, medical, injury, third party liability and cancellation insurance. All Team-building Activities are covered by insurance.

FORCE MAJEURE
18. A Party is excused from performing its obligations to the extent it is prevented by Force Majeure. On becoming aware of a Force Majeure event, a Party must immediately notify the other Party in writing of the occurrence of that event.
19. Each Party must make all reasonable efforts to minimize the effects of the event.
20. If the affected Party is prevented by the Force Majeure event from performing its obligations under this Agreement for 60 days or such other period as the Parties agree in writing, then the other Party may in its sole discretion terminate this Agreement by giving notice in writing of termination to the other Party.
21. Force Majeure events include Acts of God (including fire, flood, earthquake, typhoon, tsunami or other natural disaster), war, invasion, act of foreign enemies, hostilities, civil unrest in Phuket, rebellion, terrorist activities, government sanction, blockage, embargo, labour dispute, strike, lockout or interruption or failure of electricity or telephone service.

LIABILITY
22. The Company shall not be liable for any loss, damage, injury, death or illness arising out of, or during course of the Team-building Activities other than where such injury or damage was caused by, or as a direct result of negligence or deliberate act by Company representatives.

LEGAL ISSUES
23. If a requirement of any law is at variance with a provision of this Agreement, the Parties shall immediately notify each other upon discovering the variance and take reasonable steps to resolve the issue in a timely manner.
24. This contract will be construed in accordance with Thai Law and it is agreed that each party will submit to the jurisdiction of the Thai Courts.

MODIFICATION
25. This Agreement may not be altered, amended or modified in any way except by a written statement. Any such agreed change shall, once signed by both Parties, become a part of this Agreement.
Planning and Organisations’s
What the Client may need to arrange
• Return travel arrangements at the beginning and end of Event plus any visas required.
• Any necessary vaccinations or medication.
• Delegates’ allowance for small extras, if so chosen (e.g. for drinks, souvenirs, personal travel insurance etc.
What SIA can arrange to assist the Client
• Transportation.
• Booking accommodation.
• Hire of vehicles.
• Dinner/Lunch/Picnic/BBQ and other catering.
Things to Bring for Crew Team Building/MICE Activities
• The Company requires that the Client’s delegates wear trainers, Crocs, tennis shoes. It is not safe to go without shoes or open-toed shoes, such as sandals;
• waterproofs
• sunscreen/block – essential
• sun glasses
• sun hat
• swimming costume
• clothing in a soft bag with change of clothes.
